Terms Governing the Reproduction and Use of the National Woman's Party Collection
The National Woman's Party encourages the non-commercial use of its collections by scholarly, educational, and non-profit individuals and organizations. Commercial use is defined but not restricted to all for-profit organizations, corporations, businesses, or ventures and includes reproductions in books, calendars, corporate annual reports, and other printed matter; films and other media productions; and advertising, decorating, and packaging. All permission fees (PDF) are non-refundable and help support the National Woman's Party and its collection. Additional fees may be charged for complicated orders or for excess staff time.
The permission to use an image from the National Woman's Party collection is granted as long as the following conditions are met:
- Images belonging to the National Woman's Party collection may not be reproduced, resold, or published without the written permission of the National Woman's Party. The organization will only grant reproduction permission for objects in which the National Woman's Party is the copyright holder or for which there are no restrictions in terms of intellectual property rights.
- Permission is for non-exclusive, one-time use per medium, for North American rights only. The National Woman's Party retains all rights to the images, and they may not be used for any other purpose than that listed on the Image Use Permission application. The National Woman's Party does not offer exclusive rights to any user, publisher, author, or photographer, and assumes no responsibility for duplication of subjects by others or any responsibility for claims by third parties.
- Permission must be requested in writing and include a detailed description about how the image will be used and for how long. Requests should be as detailed as possible. The organization expects information on every crucial aspect of the publication to make an informed decision. If patrons have questions about what to include, they should contact the collection staff or another staff person to obtain full details. Possession of a National Woman's Party image does not constitute permission to use it.
- If the image is still under copyright and the copyright is not held by the National Woman's Party, the requestor must seek permission from the creator of the work or from the current copyright holder. When copyright does not belong to the National Woman's Party, the staff will provide as much information as is available to aid the researcher in locating the copyright holder; however, collection staff cannot serve as an intermediary to obtain permission on behalf of the researcher.
- The National Woman's Party assumes no responsibility for infraction of copyright laws, invasion of privacy, or any other improper or illegal use that may arise from reproduction of any image. In consideration of the National Woman's Party's furnishing of an image, the publisher/user agrees to defend, fully indemnify, and hold harmless the National Woman's Party or its employees from and against any and all claims, actions, liabilities, expense, losses or damages (including but not limited to any based on libel, slander or on rights of privacy or of publicity or on infringement of copyright or other literary or artistic rights claimed by others, irrespective of whether such claim arises out of any act or omission of the publisher/user or any act or omission of any independent contractor having a contract with the publisher/user) including reasonable attorney's fees, arising out of the use, publication, distribution, exhibition or dissemination of any or all said images by the publisher/user or his or her agents or employees.
- Credit must be given to the National Woman's Party and the creator of the work, if known. The National Woman's Party credit line must appear on or near each image reproduced, or on a credit page that indicates the page number and position on the page, in a manner accessible to the public. If the image is part of a special collection or if the photographer's name is known, that information must appear as well. Credit lines will be supplied by the National Woman's Party. The credit line for images received from the Sewall-Belmont House and Museum should read: Courtesy of the National Woman's Party Collection, The Sewall-Belmont House and Museum, Washington, D.C.
- The National Woman's Party collection contains many images that do not belong to the organization, but to other individuals and organizations. The staff will attempt to identify such images, but it is the responsibility of the user to obtain reproduction permission from the copyright owner.
- The images obtained from the organization cannot be altered or manipulated beyond the requirements of normal image enhancement or cropping to suit design and layout. Nothing will be done to change the integrity of the image.
- The National Woman's Party requests that at least one copy of any publication containing reproductions of its images be presented to the organization without charge. The above considerations apply equally to images to be used on-line. Please send to: Collections Manager, Sewall-Belmont House and Museum, 144 Constitution Avenue, NE Washington, DC 20002.
- Although fees are not assessed in some cases (personal, academic, or government use), users must still obtain permission to use the images from either the National Woman's Party or the copyright holder.
- Payment of the reproduction/usage fee entitles the user to use the image at the specified site only. The user is prohibited from transmitting the image to another site without the knowledge or permission of the National Woman's Party.
- Images may be downloaded to a printer by the user for individual use only, not for resale.
- The user must sign a Reproduction and Usage Agreement and follow its requirements. The National Woman's Party reserves the right to decline permission to publishers and individuals who have not complied with the conditions set forth.
